    DEFINITIONS :<\/strong><\/p>\n\n\n\n

    ORDER<\/strong> or RESERVATION<\/strong> or RENTAL<\/strong>: Purchase of Services. SERVICES<\/strong>: seasonal rental of accommodation or bare “tourism” pitches. ACCOMMODATION<\/strong>: Tent, caravan, mobile leisure home and light leisure home.<\/p>\n\n\n\n

    ARTICLE 1 – SCOPE OF APPLICATION<\/h2>\n\n\n\n

    These General Terms and Conditions of Sale apply, without restriction or reservation, to all rentals of accommodation or bare pitches on the le suroit campsite, operated by SARL camping le suroit, to non-professional customers (“Customers” or “Customer”), on its website www.campinglesuroit.com or by telephone, 0298500176, post or e-mail contact@campinglesuroit.com), or at a location where the Service Provider markets the Services.\nThey do not apply to pitch rentals for mobile leisure homes (mobile homes), which are covered by a “leisure” contract. <\/p>\n\n\n\n

    The main characteristics of the Services are presented on the www.campinglesuroit.com website or on a written medium – paper or electronic – in the event of reservation by a means other than a remote order.<\/p>\n\n\n\n

    The Customer is obliged to read them before placing any order.\nThe choice and purchase of a Service is the sole responsibility of the Customer. <\/p>\n\n\n\n

    These General Terms and Conditions of Sale apply to the exclusion of all other terms and conditions of the Service Provider, in particular those applicable to other sales channels for the Services.<\/p>\n\n\n\n

    These General Terms and Conditions of Sale are accessible at all times on the website and shall prevail, where applicable, over any other version or any other contractual document.\nThe version applicable to the Customer is that in force on the website or communicated by the Service Provider on the date the Order is placed by the Customer. <\/p>\n\n\n\n

    In the absence of proof to the contrary, the data recorded in the Service Provider’s computer system constitutes proof of all transactions concluded with the Customer.<\/p>\n\n\n\n

    Under the conditions defined by the French Data Protection Act and the European Data Protection Regulation, the Customer has the right to access, rectify and, if the processing is not essential to the execution of the order and the stay as well as their consequences, to oppose, at any time, all of his\/her personal data by writing, by post and providing proof of his\/her identity, to: camping le suroit 2265 route de la corniche 29910 Tr\u00e9gunc.<\/p>\n\n\n\n

    The Customer declares that he\/she has read these General Terms and Conditions of Sale and has accepted them either by ticking the appropriate box before completing the online Order procedure, or by accepting the general terms and conditions of use of the www.campinglesuroit.com website, or, in the case of off-line reservations, by any other appropriate means.<\/p>\n\n\n\n

    ARTICLE 2 – RESERVATIONS<\/h2>\n\n\n\n

    The Customer selects the services he wishes to order on the website or on any document sent by the Service Provider, according to the following procedure:<\/p>\n\n\n\n

    Following a request by internet, telephone or post, we will send you a contract to complete.\nWithin 15 days of receipt, simply fill it in and return it signed, together with a deposit.\nIt is also possible to book directly via the website.\nThe deposit can be paid by cheque, bank transfer, credit card or vacation vouchers.\nOn receipt of the deposit, a confirmation letter is sent. <\/p>\n\n\n\n

    It is the Customer’s responsibility to check the accuracy of the Order and to notify the Supplier immediately of any errors.\nThe Order will only be considered definitive after confirmation of acceptance of the Order has been sent to the Customer by the Service Provider, by e-mail or post, or by signature of the contract in the case of reservations made directly on the premises where the Service Provider markets the Services. <\/p>\n\n\n\n

    Any Order placed on the www.campinglesuroit.com website constitutes the formation of a distance contract between the Customer and the Service Provider.<\/p>\n\n\n\n

    All Orders are personal and cannot, under any circumstances, be transferred.<\/p>\n\n\n\n

    ARTICLE 3 – PRICES<\/h2>\n\n\n\n

    The Services offered by the Service Provider are provided at the prices in force on the website www.campinglesuroit.com, or on any information medium of the Service Provider, when the order is placed by the Customer.\nPrices are quoted in Euros, exclusive of VAT. <\/p>\n\n\n\n

    Prices take into account any discounts offered by the Service Provider on the www.campinglesuroit.com website or in any other information or communication medium.<\/p>\n\n\n\n

    These prices are firm and non-revisable during their period of validity, as indicated on the www.campinglesuroit.com website, in the e-mail or in the written proposal sent to the Customer.\nBeyond this validity period, the offer is null and void and the Service Provider is no longer bound by the prices. <\/p>\n\n\n\n

    The payment requested from the Customer corresponds to the total amount of the purchase.<\/p>\n\n\n\n

    An invoice is drawn up by the Vendor and sent to the Customer at the latest upon payment of the balance of the price.<\/p>\n\n\n\n

    3.1.\nTAXE DE S\u00c9JOUR <\/h3>\n\n\n\n

    The tourist tax, collected on behalf of the commune\/commune, is not included in the rates.\nIts amount is determined per person per day and varies according to destination.\nIt must be paid when paying for the service, and is shown separately on the bill. <\/p>\n\n\n\n

    ARTICLE 4 – TERMS OF PAYMENT<\/h2>\n\n\n\n

    4.1.\nACOMPTE <\/h3>\n\n\n\n

    Sums paid in advance are deposits.\nThey constitute an advance on the total price due by the customer. <\/p>\n\n\n\n

    A deposit corresponding to 25% of the total price of the Services ordered is required when the order is placed by the Customer.\nIt must be paid on receipt of the definitive rental contract attached to the copy to be returned.\nIt will be deducted from the total amount of the order. <\/p>\n\n\n\n

    no reimbursement will be made by the Service Provider in the event of cancellation by the Customer.<\/p>\n\n\n\n

    The balance of the stay must be paid in full on the day of arrival.<\/p>\n\n\n\n

    4.2.\nPAIEMENTS <\/h3>\n\n\n\n

    Payments made by the Customer shall not be considered final until actual receipt of the sums due by the Service Provider.<\/p>\n\n\n\n

    4.3.\nNON-RESPECT DES CONDITIONS DE PAIEMENT <\/h3>\n\n\n\n

    In addition, the Service Provider reserves the right, in the event of non-compliance with the above payment conditions, to suspend or cancel the supply of Services ordered by the Customer and\/or to suspend the performance of its obligations after formal notice has remained without effect.<\/p>\n\n\n\n

    ARTICLE 5 – SUPPLY OF SERVICES<\/h2>\n\n\n\n

    5.1.\nMISE A DISPOSITION ET UTILISATION DES PRESTATIONS <\/h3>\n\n\n\n

    The accommodation or pitch may be occupied from 3 p.m. on the day of arrival and must be vacated by 10 a.m. on the day of departure.<\/p>\n\n\n\n

    The balance of the stay must be paid in full on the day of arrival.<\/p>\n\n\n\n

    The accommodation and pitches are intended for a specific number of occupants at the time of rental, and may under no circumstances be occupied by a greater number of people.<\/p>\n\n\n\n

    Accommodation and pitches must be returned in the same state of cleanliness as on delivery.\nFailing this, the tenant will be required to pay a flat-rate cleaning fee of between \u20ac50 and \u20ac80.\nAny damage to the accommodation or its accessories will be repaired immediately at the tenant’s expense.\nThe inventory at the end of the rental period must be exactly the same as at the beginning. <\/p>\n\n\n\n

    5.2.\nD\u00c9P\u00d4T DE GARANTIE <\/h3>\n\n\n\n

    For accommodation rentals, a security deposit of 200\u20ac is required from the customer on the day the keys are handed over, and is returned to the customer on the day the rental ends, subject to deduction of any repair costs.<\/p>\n\n\n\n

    This guarantee does not constitute a limit of liability.<\/p>\n\n\n\n

    ARTICLE 6 – DELAY, INTERRUPTION OR CANCELLATION OF STAY BY THE CUSTOMER<\/h2>\n\n\n\n

    No discount will be granted for late arrivals, early departures or changes in the number of people (whether for all or part of the planned stay).<\/p>\n\n\n\n

    6.1.\nMODIFICATION <\/h3>\n\n\n\n

    In the event of a change of dates or number of people, the Provider will do its utmost to accept requests for a change of date within the limits of availability, without prejudice to any additional charges; in all cases, this is merely an obligation of means, as the Provider cannot guarantee the availability of a pitch or accommodation, or another date; an additional charge may be requested in such cases.<\/p>\n\n\n\n

    Any request to reduce the duration of the stay will be considered by the Provider as a partial cancellation, the consequences of which are governed by article 6.3.<\/p>\n\n\n\n

    6.2.\nINTERRUPTION <\/h3>\n\n\n\n

    Early departure shall not give rise to any reimbursement by the Service Provider.<\/p>\n\n\n\n

    6.3.\nANNULATION <\/h3>\n\n\n\n

    In the event of cancellation of the Reservation by the Customer after its acceptance by the Provider less than 30 days at least before the date scheduled for the reserved Rental, for any reason whatsoever except force majeure, the full balance of the stay will be due, the deposit paid on the Reservation, as defined in Article 4 – PAYMENT CONDITIONS of these Terms and Conditions of Sale will be automatically acquired by the Provider, as compensation, and may not give rise to any refund.<\/p>\n\n\n\n

    6.4.\nANNULATION EN CAS DE PANDEMIE <\/h3>\n\n\n\n

    6.4.1.\nEn cas de fermeture totale ou partielle de l\u2019\u00e9tablissement pendant les dates du s\u00e9jour r\u00e9serv\u00e9 (\u00e0 laquelle est assimil\u00e9e \u00e0 une mesure d\u2019interdiction totale ou partielle d\u2019accueil du public, dans la mesure ou le Client est concern\u00e9 directement par l\u2019application de cette mesure) d\u00e9cid\u00e9e par les pouvoirs publics, et qui n\u2019est pas imputable au Prestataire, les sommes vers\u00e9es d\u2019avance par le Client au titre de la r\u00e9servation du s\u00e9jour feront l\u2019objet d\u2019un remboursement dans un d\u00e9lai de 30 jours <\/p>\n\n\n\n

    However, the Service Provider cannot be held liable for any additional compensation beyond this reimbursement of sums already paid for the reservation of the stay.<\/p>\n\n\n\n

    6.3 CANCELLATION, any cancellation of the stay duly justified by the fact that the Customer is affected by COVID 19 (infection) or another infection considered to be part of a pandemic, or is identified as a contact case, and that this situation would jeopardize his\/her participation in the stay on the scheduled dates.<\/p>\n\n\n\n

    • without severance pay<\/li>\n<\/ul>\n\n\n\n

      The Service Provider shall retain any processing and management fees as stipulated in the General Terms and Conditions.\nIn all cases, the Customer must provide proof of the event making him\/her eligible for this right of cancellation. <\/p>\n\n\n\n

      6.4.3.\nPar d\u00e9rogation aux dispositions de l\u2019article <\/p>\n\n\n\n

      6.3 CANCELLATION, in the event that the Customer is forced to cancel the entire holiday due to government measures preventing participants from travelling (general or local confinement, travel bans, border closures), even though the campsite is able to fulfil its obligation and welcome Customers, the Provider will issue a credit note corresponding to the sums paid by the Customer, after deduction of processing and administration costs (article 3), which will be retained by the Provider.\nThis non-refundable and non-transferable credit note will be valid for 12 months. <\/p>\n\n\n\n

      6.4.4 – If the Customer takes out specific insurance covering the risks listed in article 6.4.2 or article 6.4.3, the insurance indemnities received by the Customer will be deducted from the amount of the refund.<\/p>\n\n\n\n

      ARTICLE 7 – CUSTOMER OBLIGATIONS<\/h2>\n\n\n\n

      7.1.\nASSURANCE RESPONSABILITE CIVILE <\/h3>\n\n\n\n

      Customers staying on a pitch or in accommodation must be covered by third-party liability insurance.\nA certificate of insurance may be requested from the customer before the start of the service. <\/p>\n\n\n\n

      7.2.\nANIMAUX <\/h3>\n\n\n\n

      Pets are welcome, under the responsibility of their owners.<\/p>\n\n\n\n

      7.3.\nR\u00c8GLEMENT INT\u00c9RIEUR <\/h3>\n\n\n\n

      Rules and regulations are posted at the entrance to the establishment and at reception.\nCustomers are required to read and respect these rules.\nThey are available on request. <\/p>\n\n\n\n

      ARTICLE 8 – OBLIGATIONS OF THE SERVICE PROVIDER – WARRANTY<\/h2>\n\n\n\n

      The Service Provider guarantees the Customer, in accordance with legal provisions and without additional payment, against any lack of conformity or latent defect resulting from a design or manufacturing fault in the Services ordered.<\/p>\n\n\n\n

      In order to assert its rights, the Customer must inform the Service Provider, in writing, of the existence of defects or lack of conformity within a maximum period of 30 days from the provision of the Services.<\/p>\n\n\n\n

      The Service Provider will refund or rectify or have rectified (as far as possible) the services found to be defective as soon as possible and at the latest within 10 days of the Service Provider’s discovery of the defect or fault.\nReimbursement will be made by credit to the Customer’s bank account or by cheque sent to the Customer. <\/p>\n\n\n\n

      The Service Provider’s guarantee is limited to the reimbursement of Services actually paid for by the Customer.\nThe Service Provider shall not be held liable or in default for any delay or non-performance resulting from the occurrence of an event of force majeure as usually recognized by French case law. <\/p>\n\n\n\n

      The Services provided via the www.campinglesuroit.com website comply with the regulations in force in France.<\/p>\n\n\n\n

      ARTICLE 9 – RIGHT OF WITHDRAWAL<\/h2>\n\n\n\n

      Activities relating to the organization and sale of holidays or excursions on a specific date or during a specified period are not subject to the withdrawal period applicable to distance and off-premises sales, in accordance with the provisions of article L221-28 of the French Consumer Code.<\/p>\n\n\n\n

      ARTICLE 10 – PROTECTION OF PERSONAL DATA<\/h2>\n\n\n\n

      The Service Provider, the writer of the present document, implements personal data processing whose legal basis is :<\/p>\n\n\n\n

        \n
      • Or the legitimate interest pursued by the Service Provider when it pursues the following purposes:<\/li>\n\n\n\n
      • prospecting<\/li>\n\n\n\n
      • customer and prospect relationship management,<\/li>\n\n\n\n
      • organizing, registering for and inviting to the Service Provider’s events,<\/li>\n\n\n\n
      • processing, executing, prospecting, producing, managing and monitoring customer requests and files, – drafting deeds on behalf of customers.<\/li>\n\n\n\n
      • Or to comply with legal and regulatory obligations when it implements processing for the following purposes:<\/li>\n<\/ul>\n\n\n\n

        – prevention of money laundering and the financing of terrorism and the fight against corruption, – invoicing, – accounting.<\/p>\n\n\n\n

        The Service Provider retains data only for as long as is necessary for the operations for which it was collected and in compliance with current regulations.<\/p>\n\n\n\n

        In this respect, customer data is kept for the duration of the contractual relationship, plus 3 years for promotional and canvassing purposes, without prejudice to retention obligations or limitation periods.<\/p>\n\n\n\n

        With regard to the prevention of money laundering and the financing of terrorism, data is kept for 5 years after the end of relations with the Service Provider.\nFor accounting purposes, data is kept for 10 years from the end of the financial year. <\/p>\n\n\n\n

        Prospective customers’ data is kept for a period of 3 years if no participation or registration in the Service Provider’s events has taken place.<\/p>\n\n\n\n

        The data processed is intended for authorized persons of the Service Provider.<\/p>\n\n\n\n

        Under the conditions defined by the French Data Protection Act and the European Data Protection Regulation, individuals have the right to access, rectify, query, limit, port or delete data concerning them.<\/p>\n\n\n\n

        Data subjects also have the right to object at any time, for reasons relating to their particular situation, to the processing of personal data whose legal basis is the legitimate interest of the Service Provider, as well as the right to object to commercial canvassing.<\/p>\n\n\n\n

        They also have the right to define general and specific directives defining the manner in which they intend the above-mentioned rights to be exercised after their death.<\/p>\n\n\n\n

          Data subjects have the right to lodge a complaint with the CNIL.<\/p>\n\n\n\n

          ARTICLE 11 – INTELLECTUAL PROPERTY<\/h2>\n\n\n\n

          The content of the www.campinglesuroit.comest website is the property of the Service Provider and its partners and is protected by French and international intellectual property laws.<\/p>\n\n\n\n

          Any reproduction, distribution or use of this content, in whole or in part, is strictly prohibited and may constitute an infringement of copyright.<\/p>\n\n\n\n

          In addition, the Service Provider retains all intellectual property rights to photographs, presentations, studies, drawings, models, prototypes, etc., produced (even at the Customer’s request) for the purpose of providing the Services to the Customer.\nThe Customer is therefore prohibited from reproducing or exploiting said studies, drawings, models, prototypes, etc., without the express prior written authorization of the Service Provider, which may be conditional upon payment of a fee. <\/p>\n\n\n\n

          The same applies to names, logos or, more generally, any graphic representation or text belonging to or used and distributed by the Service Provider.<\/p>\n\n\n\n

          ARTICLE 12 – APPLICABLE LAW – LANGUAGE<\/h2>\n\n\n\n

          These General Terms and Conditions of Sale and the operations arising from them are governed by and subject to French law.<\/p>\n\n\n\n

          These General Terms and Conditions of Sale are written in French.\nIn the event of translation into one or more foreign languages, the French text shall prevail in the event of litigation. <\/p>\n\n\n\n

          ARTICLE 13 – DISPUTES<\/h2>\n\n\n\n

          Any and all disputes arising out of or in connection with the purchase and sale transactions entered into pursuant to these general terms and conditions of sale, concerning the validity, interpretation, performance, termination, consequences and consequences thereof, which cannot be resolved between the Service Provider and the Customer, shall be submitted to the competent courts under the conditions of ordinary law.<\/p>\n\n\n\n

          The customer is hereby informed that, in the event of a dispute, he\/she may have recourse to a conventional mediation procedure or to any other alternative dispute resolution method.<\/p>\n\n\n\n

          In particular, he may have free recourse to the following Consumer Mediator:<\/p>\n\n\n\n

            ARTICLE 14 – PRE-CONTRACTUAL INFORMATION – CUSTOMER ACCEPTANCE<\/h2>\n\n\n\n

            The Customer acknowledges that, prior to placing his\/her Order, he\/she has been provided, in a legible and comprehensible manner, with these General Terms and Conditions of Sale and with all the information and details referred to in articles L 111-1 to L111-7 of the French Consumer Code, in addition to the information required in application of the decree of 22 October 2008 relating to prior consumer information on the characteristics of rental accommodation in open-air hotels, and in particular :<\/p>\n\n\n\n

            • the essential characteristics of the Services, taking into account the communication medium used and the Services concerned;<\/li>\n\n\n\n
            • the price of Services and ancillary costs ;<\/li>\n\n\n\n
            • information relating to the identity of the Service Provider, its postal, telephone and electronic contact details, and its activities, if not obvious from the context;<\/li>\n\n\n\n
            • information on legal and contractual warranties and how they apply; the functionalities of digital content and, where applicable, its interoperability;<\/li>\n\n\n\n
            • the possibility of resorting to conventional mediation in the event of a dispute ;<\/li>\n\n\n\n
